TERMS OF SERVICE FOR ANIMATION COMMISSIONS

GENERAL TERMS

Prices are subject to change based on demand, complexity of the commission order.
I have the right to reject any commission request for any reason.
"Product" means the finished state of the commissioned animation ordered by the client.
Each drawing in the animation is considered part of the "Product". See section 05

PAYMENT

Currency Accepted is either USD or CAD. I accept payment through Paypal or bank transfer.
Commissions can be paid either Full, 50% upfront then pay the rest before the Product is delivered.
Only send me a payment after I've sent an Invoice for agreed advance payment.

PROCESS & DELIVERY

The time it takes for a completion of the commission, varies between a week to month(s), depending on factors such as my health, availability, and the complexity of the commission and other work.
Once the commission is finished you will receive a Download link to the Product, in your desired file format (video and/or image Sequence).
I do not provide the project files, only the Product, Additional fees are required for the source files (tvpp, xstage).

REVISIONS

You may request as many revisions as you feel reasonable on the initial layout stage, (rough drawings). I'll only allow MINOR revision(s) after the final version is sent.
Any revision that is considered a MAJOR revision(s) outside of the initial layout stage, requires additional payment.
Misunderstandings on my side might occur due to language barrier or my colorblindness. I highly encourage to use all the tools that is available for you to convey your directions.
- Record video ref,
- Give exact color palette for me to use eye dropper tool on.
- Draw on top of my screenshots.
What counts as a MINOR or MAJOR revision.
- MINOR (After Final version)
  - Lighting or Color changes: minor tweak that's possible to change with editing software.
- MAJOR (Outside of Initial Layout Stage)
  - Frame by Frame Rework: anything that consist of Redoing something entirely from the start. Re-drawing parts because of design changes, middle of production.
  - Adding more significant cuts that is way more work compared from the initial stage.

COPYRIGHT & USAGE

I, Eleos (the artist):

I reserve the right to cancel and refund any order at any time for any reason.
I will NOT claim the intellectual property (IP) of the product.
I reserve the right to post the product and/or some Behind the Scene, publicly unless stated otherwise.
My commission price rate by default is entirely for non-commercial use of the product; said product may not be used for commercial purposes.

You (the Client):

You may upload the final product on any website and social media.
You may NOT alter the final product visually without my (the artist's) consent.
You retain the non-commercial rights to the intellectual property (IP) of the Product.
You may NOT use the product for commercial purposes unless you acquire such commercial rights.

THE FOLLOWING IS CONSIDERED COPYRIGHT INFRINGEMENT:

Claiming that you created the product by yourself.
Altering the product visually without my consent.
Using the product for commercial purposes without having purchased such commercial rights.

This includes but is not limited to;
- NFT, Block chain or any other form of Crypto-Currency.
- Promoting yourself or your brand.
- Taking a single drawing from the product and selling it as a physical merchandise (prints, charms, engraving, etc.)
- Altering the product or a drawing from the product to use for commercial purposes.

CANCELLATION & REFUND POLICY

The client is not allowed a refund once I started working on the commission.
If for any reason I am unable to start your commission you will receive a full refund.
If you cancel your order before I started it, you can get a full refund.
If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.
If you request a Paypal charge back at any point when you were not allowed to ask for a refund you will lose all aforementioned rights to the commissioned project, and I will have the full right to profit further from it in any way. I will decline the chargeback and provide Paypal with the contents of our conversations in which we talked about the commission as evidence that I have completed work for you.

WHAT DO YOU GET?

Work In Progress Pictures and Videos of the Commissioned order during the production process. I also stream occasionally unless it's under NDA.
The Final version of the commissioned work. File format is either image Sequence, GIF, or Video.
The project source files (Tvpp, Xstage) if you paid the extra fee for them.
